Owner /Operator LMIA – Based worker visas

Owner/Operator Work Permit (Owner Operator Work Permit) is suitable for entrepreneurs who are interested in starting a new business or purchasing a business in Canada and have a certain foundation in English; or have graduated students who intend to immigrate to Canada through self-employment. This program allows foreign owners and co-owners of Canadian companies to obtain a labor market impact assessment (LMIA) to apply for a work permit to come to Canada. Once approved, these owners will actively manage their Canadian business investments, increase local jobs, and promote economic development. Finally, they will gain local work experience and achieve the purpose of immigration. While the applicant enters Canada with a work permit to start a business, their spouse can apply for a Canadian Spouse Open Work Permit (Spouse Open Work Permit) to be in Canada while working, and their children can also hold a study permit to enjoy free and high-quality public education in Canada.

Application conditions:

  • Must hold a certain amount of net assets
  • Need to provide materials to prove the source of assets
  • Must have actual experience in controlling and managing an enterprise (provide proof)
  • Meets Canadian medical requirements
  • No criminal records

Additional conditions in BC:

  • Attend business inspection in designated community area and get community endorsement
  • Invest not less than 100,000 Canadian dollars to the company
  • The minimum asset requirement is 300,000 Canadian dollars
  • Create a new business with at least 51% equity
  • Create at least 1 job opportunity for Canadian citizens or permanent residents
  • CLB 4 or above in English or French
  • Have at least 3 years of business owner experience in the past 5 years, or more than 4 years of executive experience

Additional conditions in Saskatchewan:

  • The family’s net assets exceeds 500,000 Canadian dollars, and 80% is certified by a third-party agency to be obtained through legal efforts
  • Have 3 years of entrepreneurial experience in the past 10 years
  • Invest at least 200,000 to 300,000 Canadian dollars to do business in Saskatchewan and hire at least 2 Canadian employees
  • The whole family meets the medical examination requirements and security background checks, and has no criminal record

Additional conditions in Manitoba:

  • No age requirement, but it is recommended to be 25-49 years old
  • Hold certificate of High school (secondary school) and above
  • Reach CLB5 in English (IELTS G, listening, speaking, writing 5, reading 4)
  • Have at least 3 years of business management experience in the past 10 years
  • Net assets of at least 500,000 Canadian dollars, need explanation for the source
  • Investment requirements: Invest at least 250,000 Canadian dollars in Winnipeg; or at least 150,000 Canadian dollars outside the Winnipeg area; 1 local full-time employment must be created.

Process:

  1. Program positioning;
  2. Conduct an inspection of the target investment community;
  3. Submit materials to the Provincial Immigration Department;
  4. Work permit application;
  5. Carry out application assessment;
  6. Apply for permanent resident.
